Specific terms definitions

“Pier 10” refers to two registered businesses:

  1. The Cellar Door and wine sales is managed by “The trustee for Scott Baker Discretionary Trust” under the registered business name of “Pier 10 Wine”.
  2. The restaurant is managed by “The trustee for Stuart Baker Family Trust” under the registered name of “Pier 10 Restaurant”

“We”, “I” and “Us” refer to the two businesses as a collective and “My” and “Our” has a similar meaning.

  • “Privacy information” includes personal information and sensitive information.
  • “APPs” refer to the Australian Privacy Principles incorporated in the Privacy Act 1988 (Cth).


The purpose of this policy

Pier 10 is subject to the Privacy Act 1988 (Cth). The Pier 10 Privacy Policy explains in general terms how we protect the privacy of information in compliance with Australian privacy law.

How and why Pier 10 collects your privacy information.

Pier 10 only collects privacy information by lawful and fair means. In most circumstances, Pier 10 collects your privacy information directly from you in person, over the phone, email or via registration on the Pier10.com.au website. Typically, the privacy information we collect about you includes your name, your mailing address, telephone number and e-mail address.

We collect personal and business information only where reasonably necessary for one or more of the functions and activities connected to the operations of our business We collect personal information for the primary purpose of providing clients with marketing advice or services.

Individuals have a right to remain anonymous, but if you choose to not give your privacy information to us we may not be able to provide you with all services.

How Pier 10 utilises or discloses your information

Generally, Pier 10 uses and discloses privacy information for the primary purpose of contacting clients whilst providing advice or services. We also use email addresses to notify subscribers of our mailing list of advice and upcoming events.

We may also use privacy information for a secondary purpose related to the primary purpose for which you would reasonably expect us to use the collected information, unless an exception applies. An example of an exception is where you have agreed to engage a third party for the purposes of providing a service, such as a photographer for website photography.

We will not disclose privacy information collected by us to third parties for the purpose of allowing them to direct market any products and services to you, unless this was explicitly advised at the time of signing up. An example of this is where multiple businesses run a competition and you are advised that all businesses will have access to the entrants email address and name. We do however share information collected between the two businesses referred to as “Pier 10” above.

We may use your personal information to provide you with information about our services, unless you request not to receive such communications from us.

Use of cookies

When you visit our website –pier10.com.au, our server attaches a small data file called a “cookie” to your computer’s memory. Cookies are pieces of information that may be transferred to your computer’s memory when you visit a website for record keeping purposes. Most web browsers are set by default to accept cookies. If you do not wish to receive any cookies from us, you should set your web browser to refuse cookies.

At Pier 10, we use cookies to provide us with aggregate (anonymous) information on how people use our website, and to help us to know what they find interesting and useful on our website. We do not link this information to your identity or to any other information provided by you. There is no information identifying you stored inside any cookies.

Collection of anonymous information via our website

As most websites do, Pier 10 tracks usage patterns anonymously. Each time you visit pier10.com.au, a web server makes a record of your visit. Specifically, it records:

  • Internet Service Provider;
  • Date and time of visits;
  • Pages accessed and the documents downloaded;
  • Search items entered; and
  • Referring URLs (universal locators).
